- Valid professional registration with NMC, HCPC, or Social Work England
- Educated to degree level in a relevant subject
- In-depth knowledge of the interface between the Mental Capacity Act and the Mental Health Act
- Best Interest Assessor Qualification (Desirable)
- Experience of large-scale change management and service improvement (Desirable)

About the Role
The Mental Capacity Act Lead is responsible for leading the strategic direction and implementation of the Trust’s statutory duties under the Mental Capacity Act (MCA) and Deprivation of Liberty Safeguards (DoLS). The successful candidate will work closely with internal and external partners to ensure Trust-wide compliance with the MCA and DoLS, providing expert clinical leadership and guidance. Key responsibilities include developing policies, providing expert advice, and ensuring that MCA/DoLS principles are embedded within all relevant services and policies. The role is essential in protecting the rights of vulnerable patients and ensuring that legal frameworks are appropriately applied.
Key Responsibilities
- Lead the strategic development and implementation of MCA/DoLS across the Trust
- Provide expert advice on the interface between MCA and the Mental Health Act
- Work with partners to embed MCA/DoLS principles in all relevant policies
- Support clinical staff in applying the most appropriate legal frameworks
- Lead on governance and assurance work related to MCA and DoLS
